Sewing-Sanctuary Terms and Conditions

These terms apply when you use our website or buy products from Sewing-Sanctuary as a consumer. Please read them before placing an order. They explain who we are, how contracts are formed, how we supply goods and digital patterns, and what to do if there is a problem.

Nothing in these terms limits the legal rights available to you as a consumer.

1. About us

Sewing-Sanctuary is a trading name of SARK PARTNERSHIP LTD, a company registered in England and Wales under company number 10734528. Our registered office is at 1 High Street, Midsomer Norton, Somerset, England, BA3 2LE.

You can contact our customer-service team at info@sewing-sanctuary.com. Our trading and returns address is 1 High Street, Midsomer Norton, Somerset, BA3 2LE. Please contact us before sending a return so that we can provide the appropriate instructions.

2. When these terms apply

These terms apply to retail purchases made through sewing-sanctuary.com by individuals acting wholly or mainly outside their trade, business, craft or profession.

Wholesale and other trade purchases are not covered by these consumer terms. They are subject to any separate trade terms agreed with us. If you are buying for business use, please contact us before ordering.

3. Our products

We sell products including fabrics, eco-laminated fabrics, sewing patterns, downloadable PDF patterns, haberdashery, kits, gift cards and related sewing products.

We take reasonable care to describe and photograph products accurately. Images are illustrative, and colours can appear differently depending on screen settings, lighting and production batches. Natural fibres and printed fabrics may show minor variations. Where exact colour matching is important, we recommend ordering a sample before buying cut fabric.

Product measurements, weights and dimensions are approximate unless we expressly state otherwise. A minor variation that does not materially affect the product’s appearance or use will not necessarily mean the product is faulty.

4. Fabric and cut-to-length products

Fabric and other cut-to-length products are cut to the quantity you order. Where multiple units of the same product are ordered, we will normally supply one continuous piece where stock permits, but we cannot guarantee this unless we have expressly agreed it with you.

Please order enough fabric for your project and check the full piece before washing, cutting, marking or otherwise altering it. Dye lots and print batches can vary, so a later order may not match an earlier purchase exactly.

The change-of-mind cancellation rules for goods made to a customer’s specifications do not normally apply to fabric and other goods cut to the length requested. This does not affect your rights if a product is faulty, damaged, incorrectly supplied or not as described. Please see our Returns Policy below.

5. Placing an order

The website guides you through the steps needed to place an order and gives you an opportunity to check and correct your order before payment. Please check product, quantity, delivery and contact details carefully.

When you place an order, you are offering to buy the products in accordance with these terms. An automated order acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it.

For physical products, our acceptance takes place when we send you a dispatch confirmation. For digital content supplied immediately, acceptance takes place when we make the download available. A separate contract is formed for each product when it is accepted.

We may decline or cancel an order before acceptance, for example because a product is unavailable, we cannot authorise payment, there is an error in the price or description, we cannot deliver to the address supplied, or we reasonably suspect fraud or misuse. If payment has already been taken, we will refund the relevant amount.

6. Prices and payment

Prices are shown in pounds sterling unless the website states otherwise. The price payable is the price displayed when you place the order, subject to correction of obvious errors. Prices include VAT where applicable but exclude delivery charges unless stated otherwise. Delivery charges are shown before you confirm the order.

We accept the payment methods shown at checkout. Payment may be taken when you place the order. You must be authorised to use the payment method provided.

If we discover an obvious pricing or product-information error before acceptance, we may contact you for instructions or cancel the affected item and refund any amount paid. We will not be required to supply a product at an obviously incorrect price where the error could reasonably have been recognised.

7. Availability and order changes

All products are subject to availability. If we cannot supply an item, we will contact you and refund the amount paid for it. Where appropriate, we may offer an alternative, but we will not substitute a product without your agreement.

If you need to change or cancel an order, contact us as soon as possible. We cannot guarantee that a physical order can be changed once it has been prepared or dispatched, or that a digital order can be cancelled once the download has begun.

8. Delivery of physical products

We normally aim to dispatch orders within two to three working days, subject to stock availability. Dispatch estimates are not guarantees of delivery on a particular date unless we have expressly agreed that date with you.

Delivery methods, destinations, estimated times and charges are displayed on the website or at checkout. We will deliver within 30 days after the contract is formed unless a different period has been agreed with you.

Please provide a complete and accurate delivery address. If delivery is delayed or fails because of incorrect information, nobody is available to receive the parcel, or you do not follow a carrier’s instructions, we may charge reasonable additional delivery or storage costs where the law permits.

If delivery is materially delayed, please contact us. Your legal rights may include the right to cancel in circumstances where delivery by an agreed date was essential, or where we fail to deliver within a reasonable additional period you set.

9. Collection

Where collection is offered at checkout or agreed with us, we will tell you when the order is ready and how to collect it. Please do not travel to collect an order until we have confirmed it is ready. We may ask for the order confirmation and identification.

10. Risk and ownership

Physical products become your responsibility when they are delivered to you, or to a person you identify to receive them. You own the products once we have received payment in full and they have been delivered.

11. International orders

We deliver only to destinations made available at checkout. Availability, delivery methods and charges may change from time to time.

If an order is delivered outside the United Kingdom, it may be subject to import duties, taxes, customs charges or handling fees imposed by the destination country. Unless checkout expressly states that these charges are included, you are responsible for them. You are also responsible for complying with local import rules. Customs procedures may cause delays outside our control.

Consumers outside the UK may have mandatory rights under the law of their country of residence. These terms do not exclude rights that cannot lawfully be excluded.

12. Downloadable PDF patterns and other digital content

The product page will describe the file type and any compatibility or technical requirements known to us. You are responsible for ensuring that you have suitable software, equipment and internet access to download, open and print the file. Printing results may vary according to printer and paper settings.

Digital patterns are supplied automatically after payment. Before immediate supply begins, we will ask you to expressly agree to immediate delivery and acknowledge that you lose the 14-day right to cancel once downloading begins. We will confirm that agreement as part of the contract confirmation.

If the required express agreement and acknowledgement have been given, you cannot cancel merely because you change your mind after the download begins. This does not affect your rights if digital content is faulty, not as described or does not meet other legal requirements.

If you have difficulty accessing a download, contact us with your order details. We may provide reasonable assistance or a replacement link after verifying the purchase.

13. Use of sewing patterns

Unless the product page expressly states otherwise, our printed and digital sewing patterns are licensed for your personal, non-commercial use. Copyright and all other intellectual-property rights remain with the relevant rights holder.

You must not copy, share, upload, publish, resell, distribute or make a pattern available to another person, whether in full or in part. You must not use our text, illustrations, instructions, photographs or pattern pieces to create another pattern or teaching resource.

You may make garments or other finished items from a pattern for your own use. Any permission to sell finished items made from a pattern must be stated on the product page or agreed by us in writing. Purchasing a pattern does not transfer its copyright.

14. Gift cards

Any expiry date, redemption conditions and other restrictions applying to a gift card will be stated on the gift card or its product page. Gift cards may be used only in the way described there and cannot be exchanged for cash, except where required by law.

Please treat gift-card codes like cash. Contact us promptly if you believe a code has been lost, stolen or used without permission. We may require evidence of purchase before replacing or investigating a code.

15. Discounts and promotions

Promotional codes and offers are subject to the conditions stated with the promotion. Unless stated otherwise, they cannot be combined, applied retrospectively, exchanged for cash or used after expiry. We may withdraw or correct a promotion where it has been published in error, subject to orders we have already accepted and applicable law.

16. Returns cancellations and refunds

Our Returns Policy forms part of these terms and appears below. It explains cancellation periods, exclusions, return postage, refunds and what to do about faulty, damaged or incorrect products.

Nothing in these terms or the Returns Policy affects your statutory rights.

17. If there is a problem with a product

We are under a legal duty to supply goods and digital content that conform to the contract. Products must be as described, fit for purpose and of satisfactory quality, subject to the rules applying to the particular type of product.

Please contact info@sewing-sanctuary.com with your order number, an explanation of the problem and, where possible, photographs. Depending on the circumstances and your legal rights, the appropriate remedy may be a repair, replacement, price reduction or refund.

18. Our responsibility to you

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was formed, both you and we knew it might happen.

We supply products for private use. If you use a product for commercial, business or resale purposes, we will not be responsible under these consumer terms for loss of profit, loss of business, business interruption or loss of business opportunity.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory rights.

19. Events outside our reasonable control

We will not be responsible for delay or failure caused by an event outside our reasonable control. If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect. Your legal rights, including rights relating to serious delivery delays, remain unaffected.

20. Using our website

Website content is provided for general information and shopping purposes. You may use the website only lawfully. You must not interfere with its operation, attempt unauthorised access, introduce malicious code, misuse another person’s account or use website content in a way that infringes intellectual-property rights.

Unless stated otherwise, the website and its text, images, graphics, branding, videos, pattern content and other materials are owned by or licensed to us. You may view and print material for personal use connected with shopping from us, but you must not reproduce, exploit or distribute it commercially without permission.

Links to third-party websites are provided for convenience. We do not control those websites and are not responsible for their content or availability.

21. Personal information

We use personal information in accordance with our Privacy Policy, including to process orders, take payment, arrange delivery, provide downloads, prevent fraud and communicate with you about your purchase.

22. Complaints

If you have a complaint, please contact info@sewing-sanctuary.com and include your name, order number and a clear description of the issue. We will try to resolve the matter fairly and promptly.

23. Changes to these terms

We may update these terms from time to time. The terms applying to an order are those made available to you when you place that order. Changes will not alter an existing contract unless required by law or agreed with you.

24. General legal provisions

If a court or relevant authority finds part of these terms unlawful or unenforceable, the remaining provisions will continue in effect.

If we do not immediately insist that you do something required by these terms, or delay taking steps following a breach, that does not mean we have waived our rights.

The contract is between you and us. No other person has a right to enforce it under the Contracts (Rights of Third Parties) Act 1999.

25. Governing law and courts

These terms and our contract with you are governed by English law. You may bring proceedings in the courts of England and Wales. If you live in Scotland, you may also bring proceedings in Scotland. If you live in Northern Ireland, you may also bring proceedings in Northern Ireland. If you live outside the UK, you may also have rights to bring proceedings in your country of residence under mandatory local law.

Returns Cancellations and Refunds

We hope you are pleased with your purchase from Sewing-Sanctuary. If you need to return an item, please read the following policy and contact us before sending it back.

This policy applies to purchases made through our website. Nothing in this policy affects your statutory rights.

Cancelling an online order

For products that are eligible for cancellation, you may cancel your order from the time it is placed until 14 days after the day on which you receive it.

To cancel, please email info@sewing-sanctuary.com with your name, order number and a clear statement that you wish to cancel your order. You may use the model cancellation form at the end of this policy, but you do not have to.

After notifying us, you must return the products within 14 days. We recommend obtaining proof of postage, as the products remain your responsibility until they reach us.

Our 30-day returns policy

In addition to your statutory cancellation rights, we accept returns of eligible standard-stock products within 30 days of delivery.

Returned products must be unused, unwashed, unaltered and in their original condition and packaging, where applicable. Please include your order number or other proof of purchase.

Product-specific return conditions:

Cut fabric and other cut-to-length products cannot be returned because the customer has changed their mind. However, please contact us if the product has a manufacturing fault, is damaged, is not as described or we have supplied the wrong item. This does not affect your statutory rights.

Printed sewing patterns may be returned within 30 days of delivery, provided they are unused, complete and in their original packaging.

The following products are also excluded from change-of-mind returns:

· Products made, altered or ordered specially for the customer.

· Fabric or other products that have been cut, washed, marked, damaged or otherwise altered after delivery.

· Clearance items or remnants where their condition was clearly described before purchase, except where they are faulty or not as described.

· Downloadable products and gift cards.

Please check all fabric and other cut products carefully before washing or cutting them.

Return postage

If you are returning an eligible product because you have changed your mind, you are responsible for arranging and paying for the return postage.

If a product is faulty, damaged, not as described or has been supplied incorrectly, please contact us before returning it. Where appropriate, we will arrange the return or reimburse reasonable return-postage costs.

Products should not be returned without contacting us first. We will provide the appropriate return instructions and confirm the return address.

Refunds

For a valid cancellation, we will refund the price paid for the returned products and, where required by law, the cost of our least expensive standard delivery option. Additional delivery charges arising from an enhanced or express delivery service are not refundable beyond the cost of standard delivery.

We may reduce the refund if an eligible returned product has been handled beyond what is reasonably necessary to establish its nature, characteristics and functioning, and its value has consequently been reduced.

Refunds will be made to the original payment method. We will normally issue the refund within 14 days after receiving the returned products or, if earlier, receiving satisfactory evidence that they have been sent back.

Faulty damaged or incorrect products

We have a legal obligation to supply products that are of satisfactory quality, fit for purpose and as described.

Please inspect your order when it arrives and contact us promptly if a product is faulty, damaged, incorrectly supplied or not as described. Please provide your order number, a description of the problem and, where possible, photographs showing the issue.

Depending on the circumstances and your statutory rights, we will offer an appropriate remedy, which may include a refund, repair or replacement. Your rights concerning faulty products are not limited by the change-of-mind time periods or exclusions set out above.

Exchanges

We do not operate a separate postal exchange service. If you require a different eligible product, please return the original product in accordance with this policy and place a new order.

We may offer a replacement where a product is faulty, damaged or incorrectly supplied.

Colours and samples

We make reasonable efforts to display colours accurately, but colours may vary between screens and batches. Where colour matching is important, we recommend ordering a sample before purchasing cut fabric. A normal screen or batch variation is not necessarily a fault.
